Recent Court Decisions
Scanga v. Scanga, 2023 – Sadia successfully defends an appeal of a sale of home decision pursuant to the Partition Act. The Appeals Court found that the lower courts made no errors in allowing Sadia’s client a legal order to sell the parties’ matrimonial home.
Green v. Whyte, 2017 – Sadia brings a claim for “interim disbursements” on a motion for the benefit of her client, the purpose of which is to get an advance payment towards legal fees to “level the playing field” between parties. The claim was successful on 2 or 3 points, and was dismissed with the right to bring back further evidence for point 3. In an unpublished decision, the motion was brought once more and the claim for disbursements was granted.
